These Terms and Conditions govern the use of debt counselling and debt review services provided by Freedom Debt Counselling (“the Company”, “we”, “our”, or “us”) in accordance with the National Credit Act 34 of 2005 (“NCA”) of South Africa.

1. Acceptance of Terms

By using our website, submitting your information, requesting assistance, or engaging our services, you agree to be bound by these Terms and Conditions.

2. Debt Counselling Services

Freedom Debt Counselling provides debt review and debt counselling services to consumers experiencing financial difficulties. Our services may include:

  • Financial assessments
  • Debt review applications
  • Negotiations with credit providers
  • Repayment restructuring
  • Consumer budgeting assistance
  • Ongoing debt review administration

All services are provided in accordance with the National Credit Act and applicable South African regulations.

3. Eligibility

To qualify for debt review, you must:

  • Be a South African citizen or resident
  • Have a valid South African ID or passport
  • Be formally employed or receive a stable income
  • Be over-indebted or struggling to meet debt obligations

4. Consumer Responsibilities

The consumer agrees to:

  • Provide accurate and truthful financial information
  • Submit all required documentation promptly
  • Inform us of any changes to income, employment, or financial circumstances
  • Continue making agreed debt review payments on time
  • Cooperate throughout the debt review process

Failure to provide accurate information may negatively affect your debt review application or legal protections.

5. Fees and Payments

Fees charged for debt counselling services are regulated by the National Credit Regulator (NCR) guidelines and may include:

  • Application fees
  • Rejection fees (where applicable)
  • Debt counselling fees
  • Legal fees
  • After-care fees
  • Payment Distribution Agency (PDA) fees

All applicable fees will be explained before the commencement of services.

6. Debt Review Process

Once you apply for debt review:

  • Credit providers may be notified
  • Your credit profile may reflect that you are under debt review
  • You may not apply for additional credit while under debt review
  • A repayment proposal may be submitted to creditors and/or court

Debt review remains active until all obligations, excluding a home loan where applicable, are settled in accordance with the National Credit Act.

7. No Guarantee of Approval

While we aim to assist consumers professionally and effectively, Freedom Debt Counselling does not guarantee:

  • Approval of debt review applications
  • Acceptance of repayment proposals by creditors
  • Specific repayment reductions
  • Removal of legal action already instituted

8. Confidentiality and Privacy

We are committed to protecting your privacy and personal information in accordance with the Protection of Personal Information Act (POPIA).

Your information may be shared only where necessary with:

  • Credit providers
  • Payment Distribution Agencies
  • Attorneys
  • Credit bureaus
  • Regulatory authorities

9. Website Use

Users may not:

  • Use the website for unlawful purposes
  • Attempt unauthorized access to systems or data
  • Distribute malicious software or harmful content
  • Copy or reproduce website content without permission

10. Limitation of Liability

Freedom Debt Counselling shall not be held liable for:

  • Indirect or consequential losses
  • Financial losses arising from inaccurate information supplied by consumers
  • Delays caused by third parties, creditors, courts, or regulators
  • Technical interruptions or website downtime

11. Intellectual Property

All website content, branding, logos, graphics, and materials remain the property of Freedom Debt Counselling unless otherwise stated.

12. Cancellation and Withdrawal

Consumers may withdraw from debt review in accordance with applicable legislation and court procedures. Certain fees for services already rendered may still apply.

13. Amendments

We reserve the right to update or amend these Terms and Conditions at any time without prior notice. Updated versions will be published on this website.

14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.
